RETREAT ROOM WAIVER AND DISCLAIMER

EACH PERSON MUST SIGN THE WAIVER

**IMPORTANT: PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING BELOW, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS AND CONDITIONS OF THIS WAIVER AND DISCLAIMER AND WAIVE ALL RIGHTS OF CLAIM AND INDEMNIFY THE PARK AGAINST ALL DAMAGES AND CLAIMS**

You must:
– Use the chair liner and disposable socks provided whilst in massage chair
– NOT use the chair while sweaty, dirty or with any moisture on body (use the chair BEFORE the Sauna)
– Stay hydrated!

1. ACKNOWLEDGEMENT OF RISKS

**Infrared Sauna Use:**
– I acknowledge that the use of the infrared sauna involves inherent risks, including but not limited to, dehydration, overheating, dizziness, fainting, heat exhaustion, heat stroke, and exacerbation of pre-existing medical conditions. The elevated temperatures may not be suitable for everyone.

– I understand that certain individuals, such as those with cardiovascular conditions, respiratory conditions, diabetes, or those who are pregnant, should not use the sauna without prior consultation and clearance from a healthcare provider.

– I understand that infrared sauna use can cause rapid dehydration and that failure to maintain adequate hydration before, during, and after use may result in serious health consequences.

**Massage Chair Use:**

– I acknowledge that the use of the massage chair involves inherent risks, including but not limited to, muscle strain, bruising, joint discomfort, and exacerbation of existing injuries or medical conditions, particularly spinal disorders, recent surgeries, osteoporosis, or joint replacements.

– I understand that improper use of the massage chair or exceeding my body’s tolerance levels may result in discomfort or injury.

– I understand that certain individuals, such as those with medical implants (e.g., pacemakers), should not use the massage chair without prior consultation and clearance from a healthcare provider.

2. HEALTH CONDITIONS AND RESPONSIBILITIES

– I affirm that I have disclosed any relevant medical conditions to the holiday park staff and that I have consulted with a qualified healthcare provider regarding the use of the infrared sauna and/or massage chair if necessary.

– I confirm that I am not under the influence of alcohol, drugs, or any medication that may impair my ability to safely use the sauna or massage chair.

– I acknowledge that it is my responsibility to listen to my body and to discontinue use of the sauna or massage chair if I experience any discomfort, pain, or adverse symptoms. I agree to notify the staff immediately if such issues arise.

3. USE GUIDELINES AND INSTRUCTIONS

Infrared Sauna:
– I agree to follow all guidelines provided for sauna use, including time limits (20-30 minutes per session), temperature settings, and recommended hydration practices.

– I understand that I should begin with shorter sessions and gradually increase duration based on my comfort level and tolerance.

– I agree to wear appropriate clothing, such as a towel or bathing suit, and to refrain from using any oils, lotions, or substances that may damage the sauna or pose a health risk.

Massage Chair:

– I agree to follow all guidelines for massage chair use, including proper positioning, duration of use, and intensity settings. I will not adjust settings beyond my comfort level.

– I understand that massage sessions should be limited to a duration of 15-30 minutes, depending on tolerance, and I will take breaks between sessions if necessary.

– I agree to not use the massage chair immediately after a sauna session, or while sweaty or dirty, and allowing sufficient time for my body to cool down, dry off and and recover.

• I agree to use all equipment for the purposes they are designed only. Including maximum 2 person in sauna and 1 person on massage chair at all time.

4. RELEASE OF LIABILITY

– I voluntarily assume full responsibility for any risks of injury, illness, or other adverse health conditions that may result from my use of the infrared sauna and/or massage chair.

– I hereby release, discharge, and hold harmless [Caravan Park Name], its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action related to any injury, illness, or other adverse health conditions, whether caused by negligence or otherwise, that may arise from or relate to my use of the sauna and/or massage chair.

– I agree that this waiver and release is binding on me, my heirs, executors, administrators, and assigns.

5. INDEMNIFICATION

– I agree to indemnify and hold harmless [Caravan Park Name], its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising from my use of the infrared sauna and/or massage chair, including but not limited to, claims brought by third parties.

6. GOVERNING LAW AND SEVERABILITY

– This waiver and disclaimer shall be governed by and construed in accordance with the laws of Queensland Australia. Any legal action or proceeding arising out of or relating to this waiver shall be brought exclusively in the courts of Queensland Australia

– If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

7. DAMAGES 

– I take responsibility to pay for all damage or  breakages incurred during my session and agree to pay for all repairs or replacement as necessarily required to bring the equipment or accessories back to the same standard as entry.

• I will report all damage, breakages or faults to staff immediately.8.
