BATH HAUS WAIVER AND DISCLAIMER

EACH PERSON MUST SIGN THE WAIVER

**IMPORTANT: PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING BELOW, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS AND CONDITIONS OF THIS WAIVER AND DISCLAIMER AND WAIVE ALL RIGHTS OF CLAIM AND INDEMNIFY THE PARK AGAINST ALL DAMAGES AND CLAIMS**

You must:
– NOT use the facility while sweaty, dirty or with moisture on body (SHOWER RINSE BEFORE IF NEEDED!)
– NO SUNSCREENS OR CREAMS
– Stay hydrated!
– No food or drink to be put in the water or dropped in as our filters are very sensitive to organic material!

By entering and using the Bath Haus facilities, you acknowledge and agree to the following terms and conditions:

  1. Clothing Requirement: Guests must remain fully clothed at all times while using the wine barrel baths. Swimwear or modest attire is acceptable. No nudity is permitted.
  2. Personal Hygiene: To ensure a clean and pleasant experience for all guests, you must be clean before entering the baths. A shower rinse is advised before entry. If you are not sufficiently clean, you may be asked to leave.
  3. Safety Precautions:
    • Head Above Water: For your safety, guests are advised not to submerge their heads in the water
    • Age Restrictions: The wine barrel baths are available to guests aged 16 and over. Guests under the age of 18 must be accompanied by an adult (18 years or older) who will be responsible for their supervision.
    • No Intoxication: You must not enter the baths if you are under the influence of alcohol, drugs, or any substances that may impair your judgment or physical ability. We reserve the right to refuse service to anyone who appears intoxicated.
  4. Liability and Risk:
    • You enter the baths at your own risk. Stanthorpe Holiday Park is not responsible for any accidents, injuries, or medical conditions arising from the use of the facilities, including, but not limited to, drowning, slipping, or taking on water.
    • We are not liable for any health issues arising from exposure to water, including sensitivity to any chemicals used in the bath water.
  5. Damage and Responsibility: Any damage caused to the wine barrel baths, surrounding areas, or property during your use will be charged to you. You agree to pay for any damages caused during your time in the Bath Haus, either through negligence or misuse.
    • I will report all damage, breakages or faults to staff immediately.
  6. Towels:
    Towels are available for hire at a cost of $7 per person. Please ensure you bring your own towel if you prefer not to hire one.
    If you hire towels, please leave them in your cabin on departure or return to reception for cleaning.
  7. General Conduct:
    • Please be respectful of other guests’ space and maintain a peaceful and relaxing atmosphere.
    • Any behavior that disrupts the enjoyment of others or damages the property will result in immediate removal from the Bath Haus without refund.
  8. Electronics and Phones:
    • Risk of Water Damage: You acknowledge that water and electronics do not mix. By using the Bath Haus, you accept full responsibility for any personal electronics, phones, or other devices brought into the area. Stanthorpe Holiday Park is not responsible for any damage to electronics or personal property from water exposure.
    • Use at Your Own Risk: We recommend that you do not bring any electronic devices, including phones, into the bath area. If you do, you accept full responsibility for any loss, damage, or malfunction caused by exposure to water or heat.

RELEASE OF LIABILITY

– I voluntarily assume full responsibility for any risks of injury, illness, or other adverse health conditions that may result from my use of the infrared sauna and/or massage chair.

– I hereby release, discharge, and hold harmless Stanthorpe Holiday Park, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action related to any injury, illness, or other adverse health conditions, whether caused by negligence or otherwise, that may arise from or relate to my use of the sauna and/or massage chair.

– I agree that this waiver and release is binding on me, my heirs, executors, administrators, and assigns.

 INDEMNIFICATION

– I agree to indemnify and hold harmless Stanthorpe Holiday Park, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising from my use of the infrared sauna and/or massage chair, including but not limited to, claims brought by third parties.

GOVERNING LAW AND SEVERABILITY

– This waiver and disclaimer shall be governed by and construed in accordance with the laws of Queensland Australia. Any legal action or proceeding arising out of or relating to this waiver shall be brought exclusively in the courts of Queensland Australia

– If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

CONSENT AND SIGNATURE

By signing below, you confirm that you have read, understood, and agreed to these terms and conditions. You also acknowledge that you are entering the Bath Haus at your own risk, and you waive any claims against Stanthorpe Holiday Park for injury, damage, or loss sustained while using the facilities, including those arising from the use of electronic devices.
